DUB CLUB Agent Rewards Program Terms and Conditions 

Effective May 15, 2026 

Williams Homes, Inc. ("Williams Homes," "we," "us," or "our") offers the DUB CLUB Agent Rewards Program (the "Program") to eligible licensed real estate agents. These Terms and Conditions ("Terms") govern your participation in the Program. By creating a DUB CLUB account, enrolling, or otherwise participating, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not participate. 

1. Eligibility 

  • The Program is open only to licensed real estate professionals (salespersons or brokers) in good standing in California, Idaho, Montana, and any other states where Williams Homes operates and where you are properly licensed. 
  • You must maintain an active real estate license and comply with all applicable state real estate laws and regulations. 
  • Employees, officers, directors, and immediate family members of Williams Homes or its affiliates are not eligible. 
  • Participation is subject to verification of your license and broker affiliation. You must provide any required documentation (e.g., broker consent or W-9) upon request. 
  • One account per agent. Multiple accounts or use of aliases will result in termination. 

2. Program Overview and Tiers 

The Program rewards you for closed sales of Williams Homes properties and championing our brand. Benefits are tiered based on the number of closed sales of Williams Homes homes attributed to you during the applicable period (typically the prior 12 months; see Program materials for exact calculation rules). 

  • INSIDER (0–2 closed sales): Exclusive access to DUB CLUB Rewards, broker events, and first-look listings. 
  • ELITE (3–4 closed sales): All Insider benefits +0.50% Sales Commission bonus
  • LEGACY (5+ closed sales): All Elite benefits +0.50% Sales Commission bonus enhanced recognition as a Top Tier Partner. 

Tiers are evaluated periodically (e.g., quarterly or annually). We may adjust tier thresholds or qualification periods at our discretion. Commission bonuses are paid through your broker in accordance with your brokerage agreement and applicable closing documents. Total incremental commission bonus not to exceed one percent (1.00%) above the advertised broker co-op. 

 

PLUS Rewards: Additional cash-equivalent rewards or recognition for social media engagement, event attendance, and referring other licensed real estate professionals to the Program (subject to separate rules and verification). 

3. Earning Points and Rewards 

  • Points are earned for: approved social media activity, brand advocacy, event participation, and agent referrals (as detailed in Program materials or your account dashboard). 
  • Points have no cash value; they may only be redeemed for gift cards or other rewards pursuant to the applicable terms and conditions at the time of redemption. 
  • All points, bonuses, and rewards are subject to verification and our approval. We reserve the right to deny, adjust, or forfeit any points earned through fraud, misrepresentation, or violation of these Terms. 
  • Sales must close and fund while you are an active participant and formally affiliated with the transaction. 

4. Redemption 

  • Redeem points for instant gift cards or other rewards via your DUB CLUB account. 
  • Rewards are non-transferable, non-exchangeable, and subject to availability and any additional terms from reward providers. 
  • Gift cards are subject to issuer terms; we are not responsible for lost, stolen, or expired gift cards. 
  • Redemption may require tax documentation (e.g., W-9). 

5. Commission Bonuses 

  • The +0.50% commission bonus (for Elite and Legacy tiers) is an additional incentive paid by Williams Homes to your brokerage for qualifying closed transactions. 
  • You are responsible for ensuring proper disclosure of this compensation to your clients where required by law. 
  • Bonuses are processed through standard commission disbursement and are subject to broker approval and all applicable real estate regulations. 

6. Taxes and Reporting 

You are solely responsible for any taxes, reporting, or other obligations arising from points, gift cards, commission bonuses, or other rewards received. We will issue IRS Form 1099 or equivalent where required by law. 

7. Modifications, Suspension, or Termination 

  • We may modify, suspend, or terminate the Program, any tier, points earning rules, or rewards at any time, with or without notice (though we will endeavor to provide reasonable notice via email or the Program site). 
  • Continued participation after changes constitutes acceptance of the changes. 
  • We may terminate or suspend your account immediately for: fraud, abuse, violation of law, license suspension/revocation, breach of these Terms, or any other reason in our sole discretion. Upon termination, unredeemed points and benefits are forfeited. 

8. Representations and Warranties 

By participating, you represent and warrant that: 

  • Your participation complies with your brokerage policies and all applicable laws. 
  • You will disclose the Program (including any compensation or benefits) to clients as required by law. 
  • You will not engage in steering, undisclosed kickbacks, or any activity that violates real estate regulations in California, Idaho, Montana, or other jurisdictions. 

9. Limitation of Liability and Disclaimers 

  • The Program is provided "AS IS" without warranties of any kind. 
  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from the Program. 
  • We are not responsible for technical issues, unauthorized access, or errors in point tracking/redemption. 
  • Our maximum liability shall not exceed the actual value of rewards earned and redeemable in your account. 

10. Privacy 

Personal information collected through the Program is governed by our Privacy Policy (available on our website or upon request). By participating, you consent to our use of your data for Program administration, marketing, and compliance. 

11. California Notice of Financial Incentive 

If you are a California resident, this section provides the required notice under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). 

By participating in the DUB CLUB Program, you may provide us with certain personal information (such as your name, contact details, professional license information, transaction and sales data, social media activity, brand advocacy data, and other details related to your participation). In exchange, we offer financial incentives and benefits, including: 

  • Tiered commission bonuses (e.g., +0.50% on qualifying sales) 
  • Redeemable points for gift cards or other rewards 
  • Exclusive access to events, first-look listings, recognition, and other perks 
  • Categories of Personal Information: Contact and identity information, professional credentials and license data, transaction and sales records, marketing/advocacy activity data, and other information you provide or that is generated through Program participation. 
  • Value of Your Personal Information: The incentives we provide are reasonably related to the value we derive from your personal information for purposes such as Program administration, business development, marketing, compliance, and improving our agent partnerships. We do not sell your personal information as part of this Program. We evaluate the overall economic benefit to our business rather than assigning a specific dollar value per data point. 
  • Opt-In: You affirmatively opt in to the Program and its financial incentives by creating an account and accepting these Terms. 
  • Right to Withdraw: You may withdraw from the Program (and revoke consent to any associated financial incentive) at any time by contacting us at [email protected] or closing your account. Withdrawal will not affect any rewards already earned and redeemable, but you will forfeit eligibility for future benefits, and points may stop accruing. Unredeemed points may be forfeited per the Program rules. 
  • No Discrimination: Exercising your CCPA rights (including opting out of the financial incentive) will not result in discriminatory treatment in violation of the CCPA.

12. Intellectual Property and Publicity 

You grant us a non-exclusive, royalty-free perpetual license to use your name, photo, likeness, and testimonials in connection with Program promotion, including, but not limited to, in any social media that you choose to share with us or when you tag us on your posts. We may feature you in marketing materials as a DUB CLUB member. 

13. Governing Law and Dispute Resolution 

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.   With the exception of payment of real estate commissions, any controversy or claim arising out of the DUB CLUB Program, shall be submitted to a two-step dispute resolution process to be administered by ARC in Los Angeles, California.  This two-step dispute resolution shall begin with mediation under ARC Low-Cost Mediation Rules, followed immediately, should any dispute remain after mediation is terminated, by final and binding arbitration by a single arbitrator under ARC Arbitration Rules.  The production of electronically stored information shall be limited to sources used in the ordinary course of business and made available using generally available technology that is convenient and cost-effective for the producing party.  Discovery of backup servers, tapes, or other sources not used in the ordinary course of business shall not be permitted.  The discovery of metadata shall not be permitted.  Judgment upon an award rendered by the arbitrator may be entered in any court having jurisdiction.    

Any dispute arising out of or related to the payment of real estate commissions shall be determined by the terms set forth in the Purchase and Sale Agreement for the subject property. 

14. Miscellaneous 

  • These Terms constitute the entire agreement between you and us regarding the Program. 
  • If any provision is held invalid, the remainder remains in effect. 
  • No waiver of any breach constitutes a waiver of any other breach. 
  • Headings are for convenience only.
